I have a situation where a tenant is disputing 2 quarterly owner’s corp payments relating to maintenance levy and a special levy for water damage to an exterior wall which is part of a common area. He believes he should’nt be paint these accounts under the retail leases Act and that these are for capital expenditure. Can you define Capital Works/Expenditure versus Maintenance. Is there any case studies I can view covering this type of enquiry?
